German Bundesländer Ministers of Finance have recently agreed on draft legislation that will introduce a secondary VAT liability for online trading platforms and marketplaces, in cases where third party traders do not declare and pay their VAT liabilities.

There has been a lot of recent uncertainty amongst companies trading in cryptocurrencies in Germany, with reports that the German Ministry of Finance (BMF) had refused to grant VAT exemptions for transactions in Bitcoin as they considered Bitcoin to be non-legal tender.
It has been announced that the German Federal ministry of Finance have now published a decree which will amend the VAT treatment of call-off stock held in Germany.
Call-off stock is the term used to describe goods, owned by a non-resident supplier, that have been sent to the customer’s country and held in stock at a ware-house or storage facility; the customer can withdraw goods as and when needed and at this point the ownership is transferred from the supplier to the client.

This means that if you are a taxable person not established in the country and you apply for VAT refund through the German e-portal you may potentially lose the right to a refund.
Berlin’s Federal Ministry of Finance has accused Italy, France and Spain of not having tight tax sanctions with huge companies, and thereby allowing these companies to avoid in the region of between 50 and 70 billion euros of tax, and inevitably draining EU funds at the same time.
